　この授業は、「国際法が現場でいかに使われているか」、そして「国際法を現場でいかにして使うか」という問題意識をもって、国際機構をめぐる国際交渉を具体的にとりあげ、その分析および実習を通じて、国際機構法の理解を深め、国際法ないし法的技術を実践的に応用する力を身につけてもらうことを目的とします。

　具体的に、2005年度は、南極条約事務局設置に関する外交交渉を事例として取り上げ、その経緯や各国の主張を整理し、法的論点を抽出します（第１回～３回）。その後、各論点（国際機構の発展史、国際法主体性、条約締結権能等）に関する法的分析を行います（第４回～９回）。最後に、事務局設置に関する外交交渉を再現し、模擬交渉を行い、法的文書の起草術、法的議論を駆使した交渉術を、実践を通じて修得します（第１０回～１４回）。

　この授業を履修するためには、国際法の基礎的素養があることが望ましいですが、授業中に提示する関連文献（必読文献および参考文献）を読みこなすことができれば、事前に国際法・国際機構法の知識がなくとも、授業を理解することは可能と思われます。授業は日本語で行いますが、事例に関する一次資料はほとんどが英語であり、また外交交渉の実践、特に起草(drafting)作業は、英語で行います。

　模擬交渉は、盛り上がりました。５名の学生が、日本、イギリス、ロシア、ベルギー、アルゼンチンの外務省法律顧問になり、教員（外務大臣）から与えられた交渉指針（訓令）に基づいて交渉します。その過程で提出された各国の事務局設置文書案、交渉を通じて議長が作成した私案、そして最終的に妥結した南極条約事務局設置文書を、こちらのページに掲載しました。

　This course aims:　

(1) To provide a basic knowledge of international law; and

(2) To understand how international law and legal techniques are actually used in practice.

　In order to achieve (1) above, the students will read a part of international law textbook, and, in the class, by lecturing and discussing its content, will deepen his/her understanding.  This year, we will read the first four (4) chapters from Christian Tomuschat, International Law: Ensuring the Survival of Mankind on the Eve of a New Century, RCADI, Vol.281 (1999).

　In order to achieve (2) above, the students will take up a specific diplomatic negotiation case in which the instructor was personally involved with, and will analyze the legal issues related to it.  The students will also learn the basic techniques of drafting of international legal instruments.  At the end, if possible, a mock diplomatic negotiation will be conducted. 

　This year, we will take up the diplomatic negotiation leading to the establishment of the Compliance Mechanism under the Basel Convention on Control of Transboundary Movement of Hazardous Wastes.  The basic documents will be provided to the students in the class.
