現在の研究の概要

　2011年6月23日、南極条約は発効50周年を迎えます。2009年には、条約採択50周年記念大会として、米国・ボルティモアで第32 回南極条約協議国会議が開催され、閣僚宣言が採択されました。今年は、南極条約事務局があるアルゼンチン・ブエノスアイレスにて、第34回南極条約協議国会議が6月20日から2週間の予定で開催されます。

　南極条約が50年の節目を迎えている今、私は、南極条約体制を今一度、国際法的に包括的に考察する必要があると考えています。特に、日本においては、鉱物資源活動をめぐる諸問題を中心に1980年代後半辺りまでは、数は少ないものの優れた研究が発表されてきましたが、1991年に採択された南極環境保護議定書を始めてとして、その後の展開を国際法的に緻密に検討した研究はほとんど皆無と言ってよいでしょう。この時期は、拙稿：

で明らかにしたとおり、協議国会議の国際法形成フォーラムとしての正当性を高める努力の一環として、会議文書の公開が始まる時期であり、一次資料を基にした本格的な南極条約体制研究が可能になる時期でもあります。私は、この10年間、公開可となったATCM資料を求めて、日本国外務省・地球環境課や国立極地研究所、そして最近では、オーストラリア南極局(AAD)にて地道な資料収集を続けてきました。部分的にではありますが、資料収集の成果を活かして拙稿：

を発表してきました。また、この頃、科学研究費「転換期南極条約体制が直面する組織的・環境的諸課題の複合研究」の採択を得て、国際法研究者のみならず、南極地域観測隊の隊員として南極に渡航した経験をもつ自然科学分野の研究者及び外務省や環境省の担当官との研究会等を開催し、南極条約体制研究の裾野を広げることができました。

　その後、外務省の委嘱を受けて自身が実際に交渉に参加する貴重な経験をさせていただいた、2005年南極環境保護議定書附属書６「環境上の緊急事態から生じる責任 (Liability)」の形成過程とその国際法的意義については、以下の拙稿を発表しました。

また、南極条約体制が直面する喫緊の課題である南極バイオプロスペクティングについては、実例紹介に留まりますが、以下の小論を発表しました。これは、科学研究費補助金「国際公域における『遺伝子探査』をめぐる科学・ビジネス・法-国際法的枠組の模索」の研究成果でもあります。

　以上の個別研究を土台としつつ、南極条約体制の全容を明らかにしなくてはならないと考えていた時に、幸いにも、１つはジュリストに、もう１つは教科書の一章において、見取図的ではありますが、現代南極条約体制をめぐる国際法上の論点を整理して提示する機会を得ました。

こうして、私の南極条約体制研究は、1991年の南極環境保護議定書の成立過程の検討を残して、ほぼ同体制の全容を明らかにしつつあると考えています。１つのまとまりのある成果として公表することが、目下の課題です。

南極条約協議国会議関連情報

　第31回南極条約協議国会議がウクライナ・キエフにて、2008年6月1日より13日まで開催されました。以下に、日本政府代表(Representative)として出席した柴田の報告を掲載します。

　今回の会議の最重要議題は、第２週目に議論された南極観光問題への対応でした。2007年暮れに観光客船エクスプローラー号が沈没し、幸い死者は出なかったものの、南極観光が危険な活動であることが明らかになりつつあります。南極を訪れる観光客、冒険旅行者などは毎年４万人以上で推移しており、こうした活動が、各国の南極観測活動の支障になったり、南極環境への影響が出たりすることが懸念されているのです。会議では、米国代表が観光作業部会の議長に選出され、南極観光問題に積極的に対応していく組織的体制が整ったと言ってよいでしょう。

　具体的には、イギリスが、南極観光問題に対する戦略ないしビジョンを定めるべきであるとする提案をしました。日本も、観光活動を規制する必要性につき科学的な根拠がある場合には、プロアクティブproactiveに対応していく必要があると発言し、昨年よりも一歩前向きな姿勢を示しました。ただ、いくつかの協議国は、プロアクティブでは不十分であり、観光活動がもたらす環境影響や安全性のリスクにつき、必ずしも科学的確実性を要求せずに、予防的にprecautionary対応すべきであると発言しました。南極観光問題に関する新たな附属書作成が必要であるとの発言（スペイン、フランス）もありました。会議では、イギリスを中心に上記「戦略」ないし「ビジョン」を次回会合にて採択するための会期間プロセスを確認しました。

　加えて、ニュージーランドは、南極観光活動のこれ以上の拡大と多様化は望ましくない、と宣言する決議案を提案しました。作業部会では、観光活動に対する南極条約の対応の現状を unmanaged、uncontrolled、unregulatedというような言葉で表そうとする立場に対し、米は、現状がアナキー状態であるかのような表現は不正確であると指摘し、ノルウェーも、ニュージーランド提案はあたかも観光活動そのものが合法ではないかのような印象を与えているとして、慎重な姿勢を示しました。日本は、相変わらず、国内法との関係で、環境への長期的な悪影響を与える可能性のある場合に限定した内容にするように要求しました。結局結論がでず、継続審議となりました。

　また、昨年に続き、陸上の常設観光施設の設置を認めないとする提案がフランスとドイツからなされました。常設施設を「ホテル」と言い換え、観測基地を小規模観光施設として利用することは排除されない（アルゼンチンの利害を反映）、などの条件を挿入することにより、ほぼこの提案はコンセンサスが得られる状況でありました。しかし、日本は、「ホテル」と名付けられるだけで、当該施設が必ず重大な環境影響を与えることにはならず（雪でつくった「かまくら」にホテルと名付けて観光客に一時的に利用させるような活動は、南極環境保護議定書及びそれを担保している国内法では規制できないはず）、現行法ではこの決議内容は実施できないとして反対しました。このように、いくつかの決議案は日本の反対により採択されない状況でしたが、（２年前に米国が経験したような）日本バッシングがあったかというと、そうではありませんでした。日本は、観光活動の実態につき環境NGO等とも共同して関係国から情報提供を求めたり、法的拘束力のない決議であっても真剣に取り扱うことなどを、議場内外で丁寧にそして真摯に説明して、理解を求めていたからでした。仏・独案が採択されえない状況になった直後、ドイツの代表が私のところに近寄り、「決議が採択されなかったのは残念であるが、日本の立場は良くわかった。お互い何らかの対応が必要であることは一致しているのだから、双方が受け入れられる方法を今度は一緒に考えていこうじゃないか」と声をかけてくれました。これが信頼される外交のやり方なのです。

　南極バイオプロスペクティング活動に関する議論は、第１週目の法組織事項作業部会で行われました。バイオプロスペクティングとは、有益な化合物や遺伝子情報を得るために生物資源を探査することであり、南極では、極限環境に生息する動植物・微生物などから不凍性タンパク質などが発見されており、その一部については特許の対象にもなっており、化粧品や医薬品、食品などに既に有効利用されているものもあります。議論では、こうした南極バイオプロスペクティング活動が、もし商業的に大々的に行われるならば、南極環境や南極科学活動への影響がでるのではないか、さらに、全人類の利益のためにある南極において採取された遺伝子資源が、一部先進国企業により独占的に利用され彼らが莫大な富を得ているのは、南極条約の精神に反するのではないか、といった懸念が一部の国から提起されているのです。ただ、バイオプロスペクティング活動と科学活動としての生物資源の調査や研究との境は必ずしも明確ではなく、バイオプロスペクティング活動の規制が実質的に科学活動の自由をも規制するのではないか、という懸念も他方で表明されています。

　さて、作業部会では、オランダより会期間ウェッブベース協議の結果報告が行われ、フィンランド、スウェーデンなどは議論の進展を望む旨発言しました。イギリスは、バイオプロスペクティング活動とその後の特許取得は南極条約第３条の科学調査の自由に反する可能性があると指摘し、これにノルウェーも賛同しました。フランスは、同活動をしっかり把握し規制するためにも、バイオプロスペクティング活動の定義を確立しなければならないと発言しました。以上の議論をまとめる形で、オランダは、南極バイオプロスペクティング活動のデータベースの検討を行い、条約第７条５項に基づく情報提供を精査し、同活動の定義を含むコンセプトにつき検討する会期間会合の設置を提案しました。ニュージーランドも、バイオプロスペクティング活動の定義などの検討は有益であると認めつつ、科学活動の結果から新たな発明が得られ、それに特許を取得して後に商業的に利用するプロセスは大変複雑であるとして、慎重な検討が必要であると発言しました。
　これに対し、アルゼンチンはバイオプロスペクティング活動の定義を試みることは不適切であると発言。米国は、バイオプロスペクティング活動の複雑且つグローバルなコンテクストを指摘し、この問題を扱うには生物多様性条約や国連海洋法条約における議論状況も踏まえる必要があること、さらに、この問題は、南極における領土権を凍結している南極条約第４条にも係わる可能性があるとして、そもそも南極条約の下で審議する必要があるかについて疑問を呈しました。日本は、南極バイオプロスペクティングの実態把握こそが重要であるとして、その観点から、ベルギーが提出した「南極バイオプロスペクティング活動データベース」に掲載されているデータには、多くの日本企業や日本の大学、日本の研究者があたかも南極でバイオプロスペクティング活動を行っているかの如く記載されているが、必ずしもそうではないことを具体例を挙げながら説明しました。日本は、さらに、実態把握を科学的・客観的に行うために、南極バイオプロスペクティング活動の実態につき、南極研究科学委員会(SCAR)に調査させ、次回会議までに報告書を提出させる案を提案しました。

　議論の結果、オランダの会期間会合設置提案は、同会合のマンデートにつき合意が得られず、採択されませんでした。SCARに検討依頼する日本提案は、米国からの支持もあり、具体的にどのような内容で調査を依頼するかを定めたTerms of Referenceにつき会議で合意にいたることができました。SCARからの報告書も含め、いよいよ次回米国での会合では、南極バイオプロスペクティング活動に対する南極条約体制の対応振りの方向性を決する重要な議論が行われるものと予想されます。

第３０回南極条約協議国会議がインド・ニューデリで開催されました。以下に、日本政府代表代理として出席した柴田の報告を掲載します。

南極条約（１９５９年採択）の下で開催される南極条約協議国会議(Antarctic Treaty Consultative Meetings=ATCM)は、「南極地域に関する共通の利害関係のある事項」（条約第９条１項）及び「南極の環境並びにこれに依存し関連する生態系の包括的な保護についての一般的な政策」（南極環境保護議定書第１０条１項）などについて協議し、決定する場です。他の条約と異なり、条約の運営負担を協議国が平等に分かち合うように（国際会議開催には多額のお金がかかります。）、ATCMは、原則として、協議国英語名によるアルファベット順にてその開催国が決まります。

　私が初めて出席した第２５回ATCM(2002)はPoland、その後、Spain、South Africa、Sweden、United Kingdomと続きました。そろそろアルファベットも終わりに近づき、Aに戻る前に、諸事情によりこれまで会議をホストしていなかった国として、今回第３０回ATCM(2007)は、インドにて開催されることになりました。因みに、来年はウクライナでの開催が決まり、再来年2009年は南極条約採択５０周年記念ですが、偶然にも、条約採択地であるアメリカにて開催されることになっています。

　今次会合の最重要議題は、南極観光の規制をめぐる問題であったと言えるでしょう。１年前の第２９回協議国会議において、５００人以上の観光客を乗せた観光船からの南極大陸上陸を禁止する決議案が提示され、米国の反対で採択されなかったことはご報告しました。今年は、会議開催前に配布された米国提案の文書(Working Paper 2)から、米国がもはやこの問題について反対しないどころか、５００人以上乗船した観光船からの上陸拒否を積極的に支持する立場に変わったことが分かっていました。日本は、現行国際法上（南極環境保護議定書）及びそれに基づく日本の国内法上、環境影響評価に関わりなく、５００人という数字でもって南極における活動を規制することはできないとして、昨年同様、こうした提案に対しては、原則反対の立場をとりました。他に、アルゼンチンも数値が恣意的だとして懸念を表明しました。

　また、昨年、陸上恒久観光施設の設置を規制しようとする決議案に対して、アルゼンチンが反対したため、決議案が採択されなかったことも報告しました。今年は、陸上施設という限定を外して、南極環境に軽微な又は一時的な影響以上の影響（環境保護議定書第第８条参照）を与える観光活動はこれを差し控えるようにとの決議案がニュージーランドから提案されました。日本は、ニュージーランド提案は実質的に議定書附属書IIで要求されている環境影響評価手続をスキップするものであるとして反対、米国も、議定書及び附属書IIの法構造はある特定の活動を政府が禁止するようにはなっていないとして懸念を表明しました。

　協議国の大勢は、政策論として、これ以上南極観光活動を増やすべきではないということではコンセンサスが出来ており、問題は、その政策論を各国の国際法及び国内法の解釈・適用論の中で如何に表明するかとなりました。厳しい文言交渉の末、日本、米国、アルゼンチン等も受け入れられる決議案となり、決議４「南極条約地域における船舶を利用した観光」、決議５「南極条約地域における観光」が協議国のコンセンサスで採択されました。これら決議は、法的拘束力はないものの、南極環境保護議定書が前提とする規制哲学を越える内容となっており、その意味では、観光問題に関する勧告XVIII-１（1994）を塗り替える画期的なものと言って良いでしょう。今後、こうした政策論を法的拘束力ある形で具現化すべきであるとの主張が出てくる可能性も否定できず、その場合、南極環境保護議定書の枠内ではもはや対応できない可能性があるでしょう。

　観光問題の他にも、法組織事項作業部会では、南極条約地域で行われるバイオプロスペクティングの問題、南極環境保護議定書附属書VI（責任附属書）の国内実施状況の報告、具体的な違法操業事例を念頭に南極海洋生物資源保全条約(CCAMLR)とATCMの関係強化の議論、予算問題を含む事務局のガバナンスの問題などが議論されました。南極条約地域におけるバイオプロスペクティングについては、問題の複雑性故に具体的な議論にはなっていませんが、他のフォーラム（生物多様性条約や国連海洋法条約）での議論や枠組作りに先んじて、南極条約協議国が本件に関しイニシアティブをとっていくべきであるということでは、ほとんど協議国が賛同しています。今後は、その中身を詰めていくことになります。今次会合では、問題整理を行うオランダを調整役とした会期間協議プロセスが設置されました。

南極条約に関する外務省からの事務委嘱は、2009年3月をもって終了しました。南極条約協議国会議へのオブザーバー参加は未だに容易ではなく、従って、2009年第32回会合から、柴田は協議国会議への出席をやめております。
